Agreement to Terms
These Terms and Conditions ("Terms") govern your use of services provided by 1836 Commercial Construction ("1836 Commercial," "we," "us," or "our"), a commercial general contractor based in Fort Worth, Texas. By engaging with 1836 Commercial or providing your contact information for project communications, you agree to be bound by these Terms.
Description of Services
1836 Commercial operates an internal construction project management platform used by our team and associated subcontractors to manage active commercial construction projects. Services include:
- Project scheduling and milestone tracking
- Budget management and cost tracking
- Daily field log documentation
- Punch list creation, assignment, and closeout management
- Subcontractor communication and notification systems
- Owner reporting and portal access
SMS Communications
The following terms apply to all SMS communications from 1836 Commercial:
- Message frequency: Up to 1 automated reminder per day per open punch list item assigned to you
- Message content: Project-related reminders only — item name, location, priority level, and project name
- One-way communication: SMS messages are automated and outbound only. Replies to these messages are not monitored or received by 1836 Commercial staff
- Message & data rates: Standard message and data rates may apply depending on your mobile carrier and plan
- To opt out: Reply STOP to any message, or contact us at jake@1836commercial.com to be removed from notifications

Email Communications
By providing your email address to 1836 Commercial for project purposes, you consent to receive automated email notifications related to punch list items and project communications. Email reminders will continue until the relevant punch list item is closed or you request removal by contacting jake@1836commercial.com.
Subcontractor Responsibilities
Subcontractors assigned to punch list items through 1836 Commercial's project management system agree to:
- Respond promptly to punch list assignments and complete assigned work in a timely manner
- Notify 1836 Commercial when assigned items are ready for review
- Maintain accurate contact information on file with 1836 Commercial
- Comply with all applicable safety, building, and trade regulations on 1836 Commercial job sites
Intellectual Property
All content within 1836 Commercial's project management platform, including but not limited to project data, documents, reports, photos, and software, is the property of 1836 Commercial Construction or its respective owners. Subcontractors and project participants may not reproduce, distribute, or use such content outside of their authorized project role without written permission.
Limitation of Liability
1836 Commercial Construction shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our notification system or project management platform, including but not limited to missed messages due to carrier issues, technical failures, or incorrect contact information on file.
Modifications to These Terms
1836 Commercial reserves the right to modify these Terms at any time. Updates will be reflected by a revised "Last Updated" date on this page. Continued engagement with 1836 Commercial following any changes constitutes acceptance of the updated Terms.
Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from these Terms or your engagement with 1836 Commercial shall be subject to the exclusive jurisdiction of the courts located in Tarrant County, Texas.
